Open records request to City of Boulder, Colorado, January 16, 2003
 
(The letter was delivered by an independent group of concerned citizens in Boulder, not directly associated with CAIR)
 
This request for ALL RECORDS from Boulder City and County (Colorado) on the 2/28/02 illegal alien workshop "No Ser Humano Es Ilegal" sponsored by Head Start and other publicly funded entities was sent out today to the City and County Clerks, regular first class to cc's. The enclosure, Janet Heimer's 3/6/02 letter was attached, in which she says her organization, Boulder County Community Services Department, Community Action Program (CAP) (a workshop sponsor) provided refreshments and childcare for attendees.

Dear Ms. Salas and Ms. North:
 
Please consider this to be a written request for records pursuant to the Colorado Open Records Act, Colorado Revised Statutes 24-72-201.
 
According to various reports, a workshop entitled "Ningun Ser Humano Es 'Ilegal" was held on February 28, 2002. The workshop sponsors included Boulder County Head Start and Boulder County Community Action Program, with contacts including current Boulder City Human Relations Commissioner Nino Gallo, and Roberto Rivero (Head Start). Apparently, the workshop was promoted in flyers printed only in Spanish and posted by various publicly funded entities including People's Clinic, Clinica Campesina, Pioneer and Columbine Elementary Schools, and the City of Boulder Office of Human Rights.
 
Jim Burrus, spokesman for Boulder County, has been quoted in local media as saying that $200 of public funds was spent on the workshop. In a phone conversation, Mr. Burrus told Terry Graham, a signatory to this request, his source for the $200 figure is City of Boulder Human Relations Commissioner Nino Gallo. Greg Avery of the Daily Camera told Graham that Laurie Herndon of El Centro Amistad indicated that she may have received payment of $200 for her involvement with the workshop.
 
This workshop provided specific, detailed written and verbal instructions and role playing skits that trained illegal aliens on how to evade detection, arrest and deportation.
 
We are concerned that this workshop may have violated numerous federal laws, and that public monies spent on the workshop constitute a misappropriation of public funds and malfeasance on the part of various Boulder City and County elected and appointed officials, employees, and nongovernmental entities and their paid representatives.
 
We hereby request copies or originals of all writings made, maintained or kept by the City of Boulder and County of Boulder and any other governmental officials, employees and commissioners that are specific to and which influenced the workshop. The Colorado Open Records Act defines "writings" to include "...photographs, tapes, recordings, digitally stored data, including electronic mail and other documentary materials, in addition to books, papers and maps..."
 
Please include copies or originals of all writings in your custody that are specific to and influenced the workshop that involve the Mexican government and its agents or representatives.
 
Please include copies of originals of all writings in your custody by all nongovernmental organizations and their representatives (e.g., El Centro Amistad, Laurie Herndon), including educational, charitable organizations, that are specific to and influenced the workshop.

Please note that it appears the workshop handout and promotional flyers were produced only in Spanish, despite the fact that English is Colorado's official language. We also have reason to believe the workshop itself was conducted only in Spanish. We further believe that some writings related to the workshop are available only in Spanish. We ask that you provide the original Spanish-language materials, and official translations into English of all writings we are requesting at no cost to us.
 
Please consider this records request a running request. By "running request" we mean that you will continue to provide us with all writings specific to the above mentioned workshop that are created after the date of your most recent production of records.
 
Because we are concerned with the misappropriation of public funds, we also request all writings in your custody that document workshop-related time and material costs, including but not limited to:
 
Staff time used for preparation for workshop (note which staff participated)
Time and cost of handout: design, production and copying
Time and cost of promotional flyer: design, production, copying, distribution
Other design, production, copying costs
Speaker or other fees paid to workshop consultants and participants
Transportation costs/mileage charges/reimbursements
Cost of facility (Boulder County Recycle Center)
--Lights, heat, electricity, audio/visual equipment, staff time to unlock/lock, cleaning, etc.
Mailing/postage costs
Any in-kind donations, contributions, volunteer time
Childcare (provided by CAP)
Refreshments (provided by CAP)
Employee time and expense sheets
Budgets
Checks/bank records
 
Thank you for your cooperation. Please notify us in writing (Charles L. King, 2870 Duke Circle, Boulder, CO 80305) as soon as the above requested writings are ready, and we will pick them up in person. We look forward to receiving the requested records within the 10-day statutory time limit.
